海外人士如何在澳洲投资购买房产?

海外人士当然可以投资购买澳洲房产。 不过购买的楼盘不论是公寓/分层单位(Apartments)、花园别墅/联排别墅(Town house)都必须是新建筑的物业、空地或计划中的房产(楼花),同时,亦需要获得外国投资 审查委员会Foreign Investment Review Board (FIRB)的批准,方可购买。 就算持有临时签证(temporary Resident visa),例如伴侣签证(partnership visa)、457 工作签证、临时技能短缺签证(temporary skills shortage visa)或学生签证等,您仍需要获得审查委员会的批准才能在澳洲购买 房产。 这是因为在购买房产时您仍然被归类为海外人士,并且必须遵循与海外人士相同的标准。

哪些人享有 FIRB申请豁免资格?

澳洲公民(Citizen)及永久居民(Permanent Resident/PR)则可豁免 FIRB申请。 据澳洲与纽西兰之间的跨塔斯曼海协定Trans-Tasman Mutual Recognition Arrangement,纽西兰公民,在购买澳洲楼盘时会获得与澳洲买家同等的权利。 不过有一个地方值得特别留意,如纽西兰公民的买家不是持「特殊种类签证Special Category (PR) visa (444签证)」并在澳洲境内签订买卖合约,则仍有可能需要缴纳外国公民印花税 。 此外,海外人士与澳洲或纽西兰公民的配偶如联名购买楼盘(Joint Tenants),亦可豁免FIRB申请的程序。

另一方面,昆士兰市政府过去亦有推出「首次置业补贴计划(first-home-owners’ grant)」以惠及年轻的昆士兰居民购买新自住物业,以助他们早日安居乐业。 自2023年11月19日起到2025 年中,市政府更将首次置业补贴金额由原来的澳元$15,000上升至$30,000,补贴计划适用于想要购买低于澳元$750,000新物业(包括土地)的昆士兰居民 ,而且,补贴计划涵括购买分层单位Apartments、花园别墅Townhouse和独立屋House & Land。 这意味着有澳洲身份首次置业人士购买这些类型的住宅时可以获得补贴金额,可称得上是2023年提早送来的圣诞礼物!

FIRB申请费用

FIRB 只可透过澳洲税务局 (ATO) 网站提交申请。 除填写资料还需要支付申请费,自2024年7月1日起政府实施新申请的收费,表1已列出FIRB现行申请费用以供读者参考(海外人士购房申请的金额取决于您计划购买的 房产的价格)。 因此,考虑预算及购买澳洲楼盘之前,客人需要仔细留意这项费用。

as an overseas individual, interested in becoming a homeowner in Australia? Have you heard about the “FIRB Foreign Investment Application Fee” that needs to be considered in the Australian property buying process? The following article will introduce the details of the “FIRB Application Fee” to provide a better understanding of the important aspects and details to be aware of when buying property in Australia.

How can overseas individuals invest in purchasing property in Australia?
Overseas individuals can indeed invest in purchasing Australian properties. However, the properties to be purchased, whether they are apartments, townhouses, or properties under development, must be newly built, vacant land, or properties in the planning stage.

Additionally, approval from the Foreign Investment Review Board (FIRB) is required to proceed with the purchase. Even if you hold a temporary visa, such as a partner visa, 457 work visa, temporary skills shortage visa, or student visa, you still need approval from the review board to buy property in Australia. This is because, when purchasing property, you are still classified as an overseas individual and must adhere to the same standards as other overseas buyers.

H2: Who qualifies for FIRB application exemption?
Australian citizens and permanent residents are exempt from the FIRB application. According to the Trans-Tasman Mutual Recognition Arrangement between Australia and New Zealand, New Zealand citizens have the same rights as Australian buyers when purchasing Australian properties. However, there is one important point to note.

If a New Zealand citizen buyer does not hold a “Special Category (PR) visa (444 visa)” and does not sign the sales contract within Australia, they may still be subject to foreign citizen stamp duty. Additionally, overseas individuals who are joint tenants with Australian or New Zealand citizens, such as purchasing property together, are also exempt from the FIRB application process.

On the other hand, the Queensland government has previously introduced the “First Home Owners’ Grant” to benefit young Queensland residents in purchasing their first residential properties, helping them settle down earlier. From November 19, 2023, until mid-2025, the government has increased the grant amount from AUD $15,000 to $30,000.

The grant program applies to Queensland residents who want to purchase new properties (including land) valued below AUD $750,000, including apartments, townhouses, and houses with land. This means that first-time buyers with Australian residency can receive the grant amount when purchasing these types of properties, making it a Christmas gift in advance for 2023!

FIRB Application Fee
FIRB applications can only be submitted through the Australian Taxation Office (ATO) website. In addition to providing information, applicants are required to pay an application fee.

From July 1, 2023, the government implemented new FIRB application fees, and Table 1 outlines the current fees for reference (the amount for FIRB foreign investment applications depends on the price of the property you plan to purchase). Therefore, it is important to carefully consider this fee when budgeting and before purchasing Australian properties.
